These videos, crafted using cutting-edge AI technologies, seamlessly superimpose innocent faces onto explicit content without their knowledge or consent. The number of such inappropriate videos has consequently exploded.
According to a recent survey, 113,000 videos were released in only the first nine months of this year, registering a 54% surge over the previous years. Moreover, statistics from this year are expected to surpass those from all previous years.

Search Engines: Unwitting Accomplices?
The role of search engines in this crisis cannot be understated. Firms like Google and Microsoft have become gateways to this dark world. Consequently, 50 to 80 percent of internet users stumble upon these deepfake sites through innocent search queries. The ease of access and visibility of these sites exacerbate the problem.
Significantly, this isn’t a localized issue, either, with tests across various countries, from Canada to Japan, consistently showcasing deepfake sites prominently in search results, highlighting the global nature of this menace.
Legal Interventions and the Impact on Victims
However, amidst this bleak landscape, there’s a beacon of hope. New York State, recognizing the gravity of this digital violation, has taken a firm stance. Championed by state senator Michelle Hinchey, new legislation criminalizes the dissemination of AI-generated explicit images without the depicted individual’s consent.
Those found guilty may be subject to significant penalties and maybe prison time. This legislation provides a deterrent to wrongdoing and gives victims legal standing to seek redress from those responsible.

Moreover, the perpetual nature of the internet compounds this trauma, and once uploaded, these images and videos remain accessible indefinitely, leading to continuous re-victimization. The emotional and psychological toll on victims is immeasurable, with many reporting feelings of violation, shame, and distress.

While legal frameworks provide a semblance of justice, the challenges of the digital age are unique and multifaceted. Traditional concepts of justice are strained when crimes are perpetually recommitted due to the unending nature of online content. As society grapples with these novel dilemmas, evolving our strategies and perspectives is imperative.
Education and awareness are crucial. The general public must be aware of the dangers and implications of deepfakes. Tech companies, too, have a role to play. They must invest in technologies that detect and flag deepfake content, ensuring it doesn’t gain traction. Moreover, collaborations between tech giants, governments, and NGOs can lead to more comprehensive solutions.
